Please read our terms of service and use carefully. The terms of rental set out below govern all of the supplies of rental items from modprop.com, inc. ("we", "us") to the customer ("you", "The Renter"). They will replace any terms and conditions contained in any document used by you and purporting to have contractual effect, and your acceptance of any rental items from modprop indicates your acceptance of these terms of trade. By using this website, the renter ("you") agrees to all terms listed below.
 

1. The renter agrees to pay modprop a deposit (non refundable) upon confirmation of booking and balance of the full fee by the due date set out in the rental agreement. A cancellation fee of 50% will apply on reserved items. A bond may also be requested at the discretion of modprop.


2. If the property is retained beyond the return date, without the express written permission of modprop, the renter renders him or herself liable to arrest for conversion or theft.


3. The property that the renter takes possession of, as detailed on the rental agreement is owned by modprop, who will retain ownership throughout the hire period. The renter has examined the property and acknowledges that the property is received in good condition and is safe and suitable for its intended use.


4. modprop will not be liable in any way in respect of any claim made against the renter for any damage caused by the renters use of the property. modprop will not be liable to the renter or any third party for any damage or loss resulting from any defect, failure or breakdown in the property from any cause. Such cause presumes an absence of any negligence on the part of modprop.


5. The renter agrees to return the property to modprop in the same condition as received on the return date detailed in the rental agreement. modprop reserves the right to demand immediate return of the property on any breach of these terms and conditions.
6. modprop reserves the right to charge additional rental time if the property is not returned by the specified date.


7. The renter agrees not to use the property in violation of any law, statute or regulation. The laws of the United States apply.


8. The renter agrees that he or she will retain possession and control of the property throughout the period of hire.


9. The renter agrees not to alter or change any property owed by modprop for any reason whatsoever.


10. The renter agrees that he or she is liable to modprop for any loss or damage of the property, or part of the property, and will be required to meet the replacement, repair or cleaning costs of the property while the property is in the renters possession. Any debt collection or legal costs incurred in collecting payment of these fees will be the responsibility of the renter/s. Renter is fully responsible for the replacement value of the property regardless of wheter a written contract has been provided.
